Energy cooperatives on the rise - New law paves the way for the creation of citizen energy communities

The draft law "On the Electricity Sector", issued for public consultation, aims to create the legal basis for the establishment of citizens' energy communities, also known as energy cooperatives.
According to the draft, citizens will have the right to join in joint structures to produce, consume, store and sell electricity, as well as to share the energy produced among community members. These communities can operate directly in the market or through aggregation, being treated as active actors in the energy system.
The draft law foresees that participation in energy communities will be open and voluntary, while members will retain their status as end customers and have the right to leave the community at any time. It also envisages that families in need will be included and benefit from these structures.
An important element is related to the rights of these communities to manage and use the distribution network in their area, in accordance with the rules to be determined by the authorities. In this context, distribution system operators will have to cooperate to facilitate the transfer of energy within the communities, while tariffs must be transparent, proportional and non-discriminatory.
The establishment of citizen energy communities is seen as a step towards decentralizing energy production and increasing the role of citizens in the market.
