The project for "contract farming" is ready - Draft law/ How will the issuance of trader certificates for farmers work?
The government aims to give a different orientation to the agricultural sector in the country, gradually moving from the traditional small farm to the modern farm connected to the market through “Contract farming”. The draft law on “Trade receipts on agricultural products”, which has begun to be discussed in the Parliamentary Committees, specifically regulates two financial instruments such as “trade receipts on future agricultural products” and “trade receipts on stored agricultural products”, which will help and influence the increase in agricultural lending by the Albanian Development Bank.
The purpose of this draft law is to provide as much financing in agriculture as possible, fast and fair payments to farmers for future and stored agricultural products, as well as the creation of a collateral system through future and stored agricultural products.
Specifically, this draft law aims to increase financing in agriculture; to encourage farmers to cultivate and produce as many agricultural products as possible; advance financing for the farmer, as well as a guarantee for the creditor to be paid in lek or in kind, with the future agricultural product; legal regulation of the relationship between the farmer and the collector of agricultural products, enabling the farmer to be paid for the product, at the time of collection or at a later time, when the selling price of the products is higher.
Referring to the report, the draft law is modern and practical, without added costs for farmers or other entities involved, such as: collectors, exporters, agro-processors, suppliers of raw materials, investors, etc. The procedure for issuing these commercial receipts is envisaged to be electronic, on the state platform "e-Albania", without fees, free of charge for all farmers, while at the same time performing the online registration as a security lien of these receipts. For the services of registration, search and deregistration in the Security Lien Registry, fees are applied according to the legislation in force.
The primary effect that this draft law is expected to bring into effect will be an increase in financing in agriculture, an increase in the cultivated area in the country, a significant increase in the quantity and improvement in the quality of agricultural products, a better functioning of the entire chain of agricultural products, from the moment of planting seedlings/seeds to the moment of sale or processing of agricultural products. Therefore, the expected positive effects are numerous with an impact on economic growth in the agricultural sector, increased welfare of farmers, as well as other entities involved in this value chain.
