"Fiscal Peace", the government approves procedures - Businesses with turnover over 14 million lek apply for e-Filing

Businesses with a turnover of over 14 million lek per year will be able to apply for the fiscal peace agreement through the electronic e-Filing system. According to the instructions of the Ministry of Finance, the application must be made by March 31 of each year, while for the first year of implementation, 2026, the deadlines will be determined by a special instruction from the Tax Directorate.
To benefit from the agreement, entities must not have unpaid or undeclared tax liabilities and must meet a series of legal criteria, including the absence of criminal proceedings for offenses in the field of taxes or money laundering.
The tax administration will also verify whether the entity is under investigation or if it is implementing concession projects. If the conditions are met, the system will automatically generate a draft fiscal peace agreement.
The document provides that taxable profit will be calculated with an increase of 18% compared to the previous year, on which preliminary tax installments will be applied. Entities will also have the opportunity to redeclare elements of the financial statements without administrative penalties.
During the validity period of the agreement, businesses will not be subject to tax audits for profit tax, except in cases where there are suspicions of fraudulent VAT schemes or concealment of income.
However, the agreement loses its validity if the business does not achieve the minimum 18% increase in profit, changes its economic activity, does not pay the installments on time or commits repeated tax violations. In case of invalidity or false declarations, the tax administration will reassess the obligations and apply interests and penalties according to the legislation in force.
