A draft law on the State Attorney's Office provides for the expansion of the institution's powers, the creation of a new function for legal assistants, and changes in the method of recruiting state attorneys.
According to the draft released for public consultation, the institution will take over the representation and protection of the property interests of local self-government bodies at all levels of courts, without special authorization from municipalities or local institutions. The accompanying report argues that the change aims to strengthen the legal protection of local government, at a time when municipalities are facing an increase in judicial disputes related to contracts, public investments and property issues.
The draft law also provides for the creation of the function of “legal assistant to the state attorney”, a new role that aims to support state attorneys in analyzing case law, preparing standard defenses and managing cases. According to the accompanying report, the creation of this function is related to the high workload of state attorneys, who attend an average of 7 to 10 court hearings per day.
Another proposed change relates to the criteria for appointing state attorneys. The draft provides that, in addition to candidates who have completed the Magistrates' School, persons with long-term professional experience as attorneys, law professors or jurists in state administration may also be appointed.
Meanwhile, the accompanying report argues that the need to strengthen the State Attorney's Office is also related to the high financial values of the cases the institution represents. According to the document, during 2025 alone, the State Attorney's Office has pursued legal proceedings worth around 8 billion lek, or approximately 84 million euros, as well as cases related to over 12 million square meters of real estate.
