Draft Law "On the Financing of Political Parties" - The Venice Commission evaluates it positively and suggests some adjustments

The Venice Commission and the General Directorate for Human Rights and the Rule of Law (DGI) have positively assessed the draft law "On the Financing of Political Parties", agreed between the Socialist Party and the Democratic Party.
Council of Europe experts assess the draft law as an important step towards modernizing the legal framework for political financing, increasing transparency and strengthening control over the income and expenses of parties. However, the Venice Commission highlights six main recommendations that, in its opinion, should be reflected in the draft. According to the opinion, there should be more control over foreign donations and strengthening the role of the CEC in supervision.
According to the Venice Commission, it should be ensured that the rules relating to the ordinary financing of political parties and those relating to the financing of election campaigns are harmonized and do not conflict with each other.
"Provide more precise and detailed regulations in the draft law itself, leaving only the technical aspects for the sub-legal acts, and ensure that the implementing rules approved by the Central Election Commission and the Council of Ministers are based on sufficiently clear, objective and predictable criteria," the opinion emphasizes.
Also, secret financing and indirect financing through third parties, as well as through entities affiliated with or controlled by political parties, should be regulated more comprehensively, and it should be clearly defined in the law that the financial reports of political parties should include, in detail and divided into several categories.
On the other hand, the Venice Commission emphasizes that more frequent financial reporting should be considered, especially during election years, as well as strengthening the supervision of political party financing.
